General Terms and Conditions of PS Photovoltaik-Süd GmbH
Information:
As a customer, you are obliged to inspect the goods upon delivery for significant damages and completeness. Any discrepancies from the delivery note or substantial visible damages must be documented by the delivery agent on the delivery note or otherwise. We also ask that you avoid scheduling binding appointments with installers for the installation of the goods prior to delivery, as our delivery times are always an estimate, typically adhered to but subject to variation based on warehouse workload.
By making a purchase in our online shop, you, as the buyer, confirm that you are entitled to acquire the offered products at the reduced VAT rate of 0% in accordance with § 12 Abs. 3 UStG. The VAT is reduced to 0% for deliveries of solar modules to the operator of a photovoltaic system, including essential components for its operation and storage units intended to store electricity generated by the solar modules, provided that the photovoltaic system is installed on or near residential properties, public buildings, or other facilities used for activities serving the common good. These conditions are deemed met if the gross installed capacity of the photovoltaic system, as per the German market data register, does not exceed or is not planned to exceed 30 kilowatts (peak).
§1 Applicability to Entrepreneurs and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer, in the version valid at the time of the order. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB).
§2 Conclusion of a Contract and Storage of the Contract Text

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer but an invitation for consumers to place an order. By ordering the desired goods, the consumer makes a binding offer to enter into a purchase agreement.
(4) When an order is received in our online shop, the following steps apply:

Confirmation by clicking the “Order” button
Review of the items in the shopping cart
Clicking the “Proceed to Checkout” button
Logging into the online shop after registration and entering login details (email address and password)
Reviewing and correcting any entered information
Submitting the order by clicking the “Place Order” or “Buy” button
Before submitting the order, the consumer can return to the webpage where the customer’s information was entered and correct errors or cancel the order process entirely by closing the browser. We immediately confirm receipt of the order via an automatically generated email (“Order Confirmation”), which constitutes the contract.
(5) Storage of the Contract Text for Orders in Our Online Shop:
We store the contract text and send the order details to you via email. You can access the General Terms and Conditions at any time on www.photovoltaik-sued.shop. Your past orders can be viewed in your customer account under My Account --> My Orders.
§3 Prices, Shipping Costs, Payment, Due Date, Taxes
(1) The stated prices include statutory VAT and other price components. Additional shipping costs may apply. If an order is incorrectly invoiced under § 12 Abs. 3 UStG, VAT may be subsequently charged.
(2) Consumers have various payment options available at checkout.
(3) If the consumer chooses prepayment, they are obligated to pay the purchase price immediately upon contract conclusion.
(4) By completing the purchase, the buyer confirms that they are an operator of a photovoltaic system with a gross installed capacity of 30kW (peak) or less and that the purchased items are intended for such use.
§4 Delivery
(1) Delivery times stated on the website and product pages are estimates based on current warehouse workload. We cannot guarantee precise delivery times. However, delivery will most likely occur within the indicated timeframe. PS Photovoltaik-Süd GmbH is not liable for damages resulting from delayed delivery.
(2) The risk of accidental loss or deterioration of the goods passes to the buyer only upon handover, even in the case of shipping.
(3) Upon delivery, it is the customer’s responsibility to inspect the goods for damages and completeness, even if this requires unpacking and checking in front of the delivery agent. Significant visible damages or missing items must be documented by the delivery agent. Only with proper documentation can we take appropriate action, such as sending replacement items. Deviations may be handled as goodwill and are not binding.
§5 Retention of Title
We retain ownership of the goods until the purchase price has been paid in full.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, took possession of the goods.

via a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached withdrawal form, but it is not mandatory.
Consequences of Withdrawal:
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except additional costs arising from choosing a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than fourteen days from the day we receive notice of your withdrawal.
We will use the same payment method for the refund as was used for the original transaction, unless expressly agreed otherwise; in no case will you be charged fees for this refund.
We may withhold reimbursement until we have received the goods back.
You must return the goods without delay and no later than fourteen days from the day you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct costs of returning the goods.
Financed Transactions:
If you financed this contract through a loan and withdraw from the financed contract, the loan agreement is also considered terminated if both contracts form an economic unit. This is particularly the case if we are your lender or if the lender used our involvement in the loan agreement. When the loan amount has already been transferred to us upon withdrawal, your lender assumes our rights and obligations under the financed contract.
